Information Provided By You

GTO is the owner of, and has absolute title to all of the software used on or in conjunction with, or referred to, on this Site, including but not limited to all tipping software and software relating to tipping competitions (&quot;GTO Software&quot;).

GTO Software

This Site offers you the opportunity to start and manage your own tipping competition. In respect of any tipping competition set up on this Site or any other website using the GTO Software (&quot;Tipping Competition&quot;), the person who sets up the Tipping Competition will become the competition manager (&quot;Manager&quot;) and will be responsible for the way in which the Tipping Competition is run.

On setting up a Tipping Competition, the Manager will be assigned a unique uniform resource locator (or URL) that provides access to a personalised tipping page (&quot;Tipping Page&quot;).

The Tipping Page is unique to that Tipping Competition and is the medium through which the Manager and all participants of that Tipping Competition can join, tip, check results and consult with the leader board. Upon joining a Tipping Competition where the Manager has set an entry fee to be paid online, each participant in the Tipping Competition will be required to pay the entry fee for that Tipping Competition, as designated by the Manager (&quot;Payer&quot;).

GTO will hold all money provided by each Payer (&quot;Tipping Competition Money&quot;) until the conclusion of the Tipping Competition and upon the conclusion of the Tipping Competition, GTO will distribute all Tipping Competition Money to the Tipping Competition winner(s), as determined by the GTO Software and authorised by the Manager. For the avoidance of doubt, GTO holds Tipping Competition Money on behalf of Tipping Competition participants as an agent only.

GTO is not responsible for or liable to anyone for distributing Tipping Competition Money as authorised by the relevant Manager. GTO does not warrant that results of a Tipping Competition will always be accurate and GTO takes no responsibility if the results are inaccurate or not available for any reason.

Credit card transaction charges are added to the competition fee that competition participants pay online to join a particular competition. The credit card charge amount is displayed on the relevant competition joining page.

Tipping Competitions

1. Conditions of Entry 
(a) By entering this competition entrants accept these Terms and Conditions. 
(b) Entry is open to Australian residents aged 18 years or older. 
(c) Employees of theGreatTipOff Pty Ltd trading as theGreatTipOff (&quot;GTO&quot;), and their immediate families and the suppliers and agencies associated with this competition are ineligible to enter. 
(d) Eligible participants can enter the competition via the GTO website. 
(e) Participants must have a GTO account to enter. (f ) The competition is free to enter. 
(g) Only one contestant per household is eligible to participate in the competition. If there is more than one contestant registered in the household who have tipped within a calendar month, than both members in the household are ineligible for a prize. 
(h) Contestants finishing in a position qualifying for a prize will be called on their registered mobile phone number and may be required to confirm certain details relating to their tipping account. GTO reserves the right to withhold prizes where responses indicate that the GTO account is not used by the phone account owner. 
(i) GTO reserves the right to refuse participation in the competition to any person. GTO will communicate this decision to the person via a SMS message to their mobile phone, an email or both.

2. Key dates 
(a) Each competition lasts for one calendar month (&quot;Competition Term&quot;) i.e. 1st day of a given month until the final day of that month 
(b) Eligible participants may enter the monthly competition at any time. Participants can enter their tips when race fields are available on the GTO website.

3. Registration 
(a) To enter the competition, an eligible person must register at the GTO website during the period of entry. 
(b) Only one entrant per household may register. Multiple entrants per household are not permitted to enter the competition. 
(c) Any participant with more than one entry (multiple GTO accounts) will be disqualified. 
(d) When registering as a new GTO account holder, entrants must accurately complete all details in the online account creation form and must specify a valid username and password which they will use when participating in the competition (&quot;GTO Account&quot;). 
(e) Entrants are solely responsible for any activity that occurs in relation to their GTO Account. Entrants must keep details of their GTO Account secure and must notify GTO immediately of any breach of security or unauthorised use of a GTO Account. GTO will not be liable for any loss to entrants caused by unauthorised use of an entrant s GTO Account.


4. Submitting tips 
(a) The competition involves registered entrants submitting at least 40 Resulting Tips within the Competition Term, in accordance with these Terms and Conditions. A Resulting Tip means a tip which has an outcome i.e. it does not include a tip for a horse which is scratched or a horse in a race which has been abandoned. 
(b) An entrant is able to tip on any horse race which is shown in the Bet &amp; Tip menu option at the Bet/Tip entry page available on the GTO website. The competition does not include tips for greyhound or harness racing events,. 
(c) Tips may only be submitted using the online process which entrants can access by logging onto the GTO website with their GTO Account. 
(d) Entrants may only tip on win outcomes. 
(e) GTO reserves the right to set a higher tip minimum for entrants who post a high volume of tips within a small period of time in a calendar month. GTO will attempt to communicate the new tip minimum to the user via their registered mobile phone number, email address or both. Entrants who enter all their tips for a calendar month on only one day, will not qualify as a prize winner. 


5. Odds 
(a) Odds used to calculate a participant's score are those displayed as &quot;Best Tote&quot; odds for a race's official results at Ladbrokes.com.au. Odds appearing at the time the Resulting Tip is entered into the system are not used to determine a participant's score. 
(b) All odds correspond with the official bookmaker odds offered by Ladbrokes.com.au pursuant to its bookmaker license. 
(c) The calculation methods and other information used by Ladbrokes.com.au in determining odds will not be disclosed to entrants. The determination of odds by Ladbrokes.com.au is final and binding on all entrants, and no correspondence will be entered into regarding odds.

6. Rankings 
(a) Following each Resulting Tip, a participant's Profit on Turnover (&quot;POT&quot;) will be determined based on the following calculation: Collective return from all Resulting Tips in the month using Best Tote odds using a virtual $1 bet, divided by the number of tips placed in the month. The POT will be displayed as a percentage. 
(b) Participants will be ranked each month based on their POT. The higher the POT, the higher the ranking.

7. Determination of winners 
(a) The participant with the highest POT at midnight on the final day of the month will be determined the winner. There will also be prizes for 2nd, 3rd, 4th and 5th place. 
(b) These winners will be determined at 10am (AEST) on the first day of the month after the Competition Term at the offices of GTO. 
(c) In the event of any two or more winners having the same POT (ie a tie), prizes will be split. The following rules apply: the prize splitting process will be such that where there is a tie for any place (1st place, 2nd place etc) the prize for that place and prize for the next lower place will be combined, and each of the tied winners will receive an equal split of the combined prize. For example, where there is a tie between two winners for the 1st prize, the 1st and 2nd prizes will be combined (to total $750 in cash) and each of the two winners will then receive half of the combined prize (ie $375 in cash).


8. Winner notification and publication of results 
(a) The participant with the highest POT at midnight on the final day of the month will be determined the winner. There will also be prizes for 2nd, 3rd, 4th and 5th place. 
(b) These winners will be determined at 10am (AEST) on the first day of the month after the Competition Term at the offices of GTO.

(d) Entrants who are classed as media tipsters, shown by their employer's name against their tipping account name are not eligible for prizes. 
(e) By the 15th of the next competition month, GTO will contact each winning participant via phone (mobile number used to register GTO account) to inform them of their prize. Cash deposits for prizes will be made into the participant's bank account that is attached to their Great Tip Off account after they have been verified via phone. GTO reserves the right to withhold any prizes if the registered user details are incorrect or are misleading. 
(f) Each participant's POT will be available on the Tipster Leaderboard on the GTO website, which will reveal the order of the winning participants.

9. Prizes 
(a) There are 5 cash prizes available for each monthly competition. These prizes are only awarded to users who join the site. They are not offered to tipsters from the media who information is entered by GTO staff. 
(b) Prizes for 1st through to 5th position are as follows.

1st: $500 
2nd: $250 
3rd: $125 
4th: $75 
5th: $50

(c) Cash deposits for prizes will be made into the participant's bank account using details appearing in the user s Great Tip Off account at the time of payment. 
(d) Prizes are not transferable. 
(f) Prize values are in Australian dollars, based on recommended retail prices, include GST and are correct at time of printing. GTO accepts no responsibility for any variation in the value of the prize.

10. Total prize value 
The total prize value on offer for each monthly competition is up to $1,000.


11. Unclaimed prizes 
Should any prize remain unclaimed after 3 months of a winner being determined, GTO may disqualify that winner and award the prize to the next entrant immediately below in ranking. Winners of any unclaimed prizes will be notified by telephone and in writing within 2 days of being determined.

12. Promoter details

13. Miscellaneous 
(a) Information regarding prizes and how to enter forms part of these Terms and Conditions. 
(b) Failure by GTO to enforce any of its rights under these Terms and Conditions at any stage does not constitute a waiver of those rights. 
(c) GTO reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age, place of residence and proof of purchase). Proof of identification, age, residency and entry considered suitable for verification is at the discretion of GTO. 
(d) GTO and its associated agencies and companies involved in this competition will take no responsibility for prizes damaged or lost in transit. Once a prize has left GTO's premises, GTO will not be responsible for any delay or failure to deliver, or damage caused to the prize during transit. (e)GTO reserves the right to refuse to allow a winner to take part in any or all aspects of the prize if GTO determines, in its absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. 
(f) GTO reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition, including by registering for this competition more than once. GTO's legal rights to recover damages or other compensation from such an offender are reserved. 
(g) If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of GTO, GTO reserves the right, in its sole discretion and to the full extent permitted by law, but subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition as appropriate. 
(h) Except for any liability that cannot be excluded by law, GTO (including its directors, officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or 
consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following: any technical difficulties or equipment malfunction (whether or not under GTO's control); any theft, unauthorised access or third party interference; any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by GTO) due to any reason beyond the reasonable control of GTO; any variation in prize value to that stated in these Terms and Conditions; any tax liability incurred by the winner or entrant; any prize or participation in or use of any prize. 
(i) By participating in this competition, each entrant assigns copyright (including future copyright) in and to any entry submitted by such entrant and, to the extent permitted by law, waives his or her moral rights in respect of same. Each entrant warrants to GTO that his or her entry does not infringe the intellectual property rights of any person. Personal information provided by entrants will be used by GTO for the purpose of conducting this competition and otherwise in accordance with entrants consent. GTO may disclose entrants personal information to its contractors and agents in relation to this competition. GTO s privacy policy is available at https://www.thegreattipoff.con/info/Privacy.

Monthly Tipping Competitions

GTO has absolute ownership and control over the Tipping Pages. GTO has unfettered discretion in relation to the Tipping Pages, including but not limited to unfettered discretion in relation to all advertising that may appear on the Tipping Pages from time to time.&nbsp;

GTO takes no responsibility for non-payment of any prize by GTO to a Tipping Competition winner, including where GTO has been provided with incorrect or invalid bank account details.

Tipping Pages

The GTO Racing competitions are conducted on the www.thegreattipoff.com website and are open to members of the general public. The competitions are free of charge. Competition prize winners will be determined by the scores on the competition leader board after being updated to reflect results of the final racing event relevant to the competition.

Official racing results taken from the relevant racing authority will be used to determine the outcome of a race for a competition. In the event that more than one Member has an equal score for a scoreboard ranking which corresponds to a prize, then the total sum of prizes allocated to the ranks of the collective group of Members with equal scores will be split between these Members.

For example if three Members get an equal score and appear at the top of the leader board, then the prizes for first, second and third are pooled and shared equally amongst the three winners.

Competitions administered by GTO

You agree to provide tips and other information relevant to horse racing, harness racing and greyhound racing that accurately represent your views and opinions.&nbsp;

The tips and information that you provide to the site must be solely your own and not those of other persons or parties. The GTO reserves the right to cancel your use of the site if it deems you have violated this condition.&nbsp;

The site allows members to add tips and comments for horse racing, harness racing and greyhound posted on the site pages for other users to view and use (&ldquo;Tip Content&rdquo;) and also to view and purchase or use the Tip Content in the process of placing a wager &nbsp;(&ldquo;Tip Service&rdquo;).

In order for us to make Tip Content that you contribute available on the site for these purposes, and to operate, market and promote the Tip Service we need to make use of such Tip Content in accordance with and subject to this Agreement.

Therefore, by contributing Tip Content to the Site you automatically grant to us an irrevocable and perpetual, non-exclusive, transferable, royalty free, fully paid, worldwide license, by ourselves or with others, to use, copy, distribute, publicly display, print, publish and republish, in any form of media or expression, in a manner in which the Tip Service permits Tip Content to be used, and to license or permit others to do.

Sales that you make from selling your tips on the site include relevant taxes, credit card processing fees and commission. Monies payable to you (&quot;payable balance&quot;) are equal to the total of net sales less the GTO commission. Net sales are calculated by subtracting relevant taxes (e.g. GST) and credit card processing fees from the tip package sale price.&nbsp;

The GTO commission rate applied to the sale of your tips equals 30% of the sale price. GTO reserves the right to modify the commission amount at any time. The payable balance is paid on the fifteenth day of each month on balances as at 11.59 pm Eastern Standard time, Australia, on the last day of the previous month for amounts equal to, or greater than one hundred Australian dollars ($100).&nbsp;

If your balance is less than $100, payment will be withheld until your payable balance reaches or exceeds this amount. If you chose to close your account, the GTO will pay your payable balance to you on the fifteenth day of the month after receiving notification from you to close your account. In the event of unforeseen operational issues or acts of God which prevent payment processes from being performed, the GTO reserves the right to delay payments to you without any liability for costs or other consequential loss associated with delayed payment.

The GTO commits to take measures available to them to resolve the issues restricting payment within a reasonable timeframe. Payments are made by bank deposit into your bank account according to the details that you provide to us. You are responsible for providing accurate personal details including name, surname, address and bank account details to be used for depositing funds into your bank account. The GTO reserves the right to deduct costs associated with fees charged by banks caused by incorrect banking information provided by you.

Your tips may also be displayed as HOT Bets, on the GTO site or on a third party site at our sole discretion. A HOT Bet is an advertisement for a tip where a Bettor (&ldquo;a person who places a bet&rdquo;) may use your tip if and only if they press on the advertisement and follow the prompts to bet on the selection advertised, via the bookmaker who we choose to digitally connect to (&ldquo;the HOT Bet process&rdquo;).&nbsp;

If a Bettor takes your HOT Bet using the HOT Bet process and the bet wins, we will remunerate to you an Advertisement Fee. The Advertisement Fee for each HOT Bet will be calculated using several factors related to the HOT Bet which include but are not limited to:

	the amount wagered on your HOT Bet; and
	the odds of the HOT Bet;

GTO reserves the right to alter the earnings pay-out calculation for the Advertisement Fee at any time and without notice. It is your responsibility to check the calculator link provided above to become aware of the current pay-out for the Advertisement Fee.

Your HOT Bet earnings will be paid under the same terms and using the same process as Tip Sales payments, as detailed in this Agreement. Both your Tips Sales and HOT Bet Advertisement Fee payments will be made at the same time and a Recipient Created Invoice or Recipient Created Tax Invoice containing details on amounts relating to Tip Sales and the Advertisement Fee will be emailed to your registered email address.

<h4>9.1 Gold Pass</h4>

The tips you place on the site may be accessed as part of the Gold Pass service which is available for purchase on the site. The Gold Pass is a weekly subscription which gives subscribers unlimited access to tips posted on the site throughout the subscription period.

You will earn commission from use of your tips through the Gold Pass service. 40% of net revenue received from each Gold Pass subscription will be shared amongst tipsters whose Tip Content has been accessed throughout the subscription period. The commission paid to a tipster is determined by the quantity of the tipster's Tip Content accessed by the subscriber throughout the subscription period and the price charged by the tipster for the Tip Content.

Payments for Gold Pass commission are made according to the terms and conditions set out in section 7 (Tipping and Selling Tips).

Tipping and Selling Tips

Users, of the site, can purchase tips posted to the site by sellers, using Visa or MasterCard. &quot;The price&quot; paid when confirming a tip purchase will be the price specified on the site. You are required to confirm your intention to buy the tips and enter your payments details. After you perform these steps on the GTO the credit card or account that you elect to pay with, will be charged the price.

All sales are non-cancelable and final. You understand that the price includes relevant taxes (e.g. Goods and sales tax), processing fees, commissions to the GTO and fees to the seller. The tipping information that you purchase will be emailed to the email address that you provide to the site and posted to your &#39;Purchased Tips&#39; page.

In the event that you do not receive an email with the tipping information that you purchase, which may result from email filter blocks, incorrect email addresses or other technical issues outside of the GTO control, you should check your &#39;Purchased Tips&#39; page to receive your purchased information.

The tipping information that you purchase is a single license to you, giving you the right to use the information for your personal recreational purposes only. You are not permitted under any circumstances to re-sell, publish, forward, communicate to another individual, use to represent your own tips on the site or any other medium, or derive any commercial benefit from the tipping information that you purchase.

WE DO NOT MAKE ANY WARRANT AS TO THE RESULTS TO BE OBTAINED FROM THE PURCHASED INFORMATION. WE DO NOT MAKE ANY WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. YOU EXPRESSLY AGREE THAT YOU WILL ASSUME ALL RISK AS TO THE QUALITY OF THE INFORMATION.

Buying and Use of Tipping information

The Personal Tipping Website service is a web publishing service (the &quot;Service&quot;) provided by the GTO where you are allocated a Unique Resource Locator (&ldquo;URL&rdquo;) which links other users to pages where your tips and other content that you add on the GTO appear. Your use of the Service gives you a right to use the URL that you chose, or to post certain pages, or website objects, that you chose on pages that appear under your chosen URL.

The site&#39;s references to &#39;your website&#39; and &#39;your own website address&#39; refer to your right to use the URL you choose and the web pages that appear under your chosen URL, in accordance with these terms and conditions. Your use of the Service does not, in any way, represent your ownership of any component of the site, your chosen URL, the web pages that contain your chosen URL or web site objects on the site.

You are solely responsible for all transactions, postings, communications and any other activities that occur under your alias (user name) on the site. As users are responsible for the content and use of the webpages that appear under the URL, the site may contain inaccurate, offensive, harmful or undesirable material.

The GTO makes no guarantees, representations or endorsements to the information posted using the Service. If your account, on the site, is inactive for a period of ninety (90) days the GTO reserves the right to cancel your account.

Cancelling your account may involve removing your right to use the URL you have chosen as part of the Service. Inactive accounts are determined by measuring the time since your last tip was recorded on the site.

The GTO reserves the right to place advertising on any page contained under the URL that you choose as part of the service. The GTO is not obligated to pay you any fees, commission or royalties for any advertising revenue or any other revenue received from web pages containing the URL you chose as part of the service. You are not permitted to use the Service to promote tips which are sold through another website or medium, without the expressed permission of the GTO.

The GTO reserves the right to add links to the &#39;Links&#39; section on the web pages containing the URL that you choose as part of the Service. The GTO is not obligated to pay you any fees, royalties or commissions for these links. You agree to provide a link to http://theGreatTipOff.com &quot;the link&quot; on your website where you embed content from the site.

You agree to ensure that the link is accessible to the general public without them having to provide access codes, usernames, passwords or undertake any steps other than up to three clicks of a mouse from the home page or main landing page on your site. The link must be continuously displayed on your website while content from the site is embedded into your website.

Your use of the GTO content, by embedding web pages into your site, is at your own risk. You agree to be bound by these terms and conditions applicable to the site when embedding the GTO content into your website.

You agree to promptly report any suspicious or unauthorised use of the Site to GTO. GTO reserves the right to monitor any and all activity on the Site and GTO may notify the proper law enforcement officials if any suspicious activity is detected.

Material Provided To Us Or Posted On Or Through The Site By You

You are solely responsible for your interactions with other users of the Site, third party developers or any other parties with whom you interact through the Site (or any related applications of the Site).

GTO reserves the right, but has no obligation, to become involved in any way with these disputes. In the event that GTO elects to become involved with any dispute, the decision of GTO is final and no correspondence will be entered into.

Disputes

If you post tips for sale on the site you understand that you are &quot;the seller&quot;. If you buy from a seller (&quot;the buyer&quot;) you have entered into a transaction with the seller. The GTO is the provider of the site, a portal to list, advertise and market sellers&#39; tips and a payment mechanism to assist sale activities on the site.

Transactions on the site are exclusively between the buyer and the seller. It is the buyer&#39;s sole responsibility to determine their legal entitlements for a refund or return from purchases made on the site.

Any dissatisfaction with any product or service purchased from the site should be addressed with the seller. The seller agrees to reimburse the GTO for all costs and expenses incurred by the GTO, relating to refunds and claims made for products and services purchased from the site. The GTO reserves the right to refund a buyer for purchases made.

In instances where the GTO chooses to refund payments, the GTO will not be liable to the seller for the refunded sale. The GTO reserves the right to deduct monies from payments to the seller for any transaction costs incurred from refunding the buyer for the seller&#39;s tips.

If the tips you purchase from a seller do not contain at least one official runner or participant (as determined by the officiating authority of the event) resulting from scratchings, abandoned races, or other means, the GTO will refund the buyer the full price of the tips purchased. The GTO reserves the right to deduct any transaction costs incurred from the refund.

There are no refunds offered for tipping competitions. Once you have paid your tipping competition fee it is final and non-cancellable. If you pay your tipping competition fee and you are the only tipper in the competition you must claim your competition fee as a prize using the GTO prize claim process at the end of the tipping competition.

Each deposit which is not used for purchases or turned over as part of an operating betting account will be charged a $25 administration fee when it is cashed out or refunded. For example 5 deposits not turned over will incur a fee of $125 (5 x $25) when cashed out or refunded.

Refunds

The Site may contain links to other websites which are owned or operated by third parties (&quot;Third Party Sites&quot;). These links are provided for convenience only.
